2021 Big Ten Football Championship Game Ticket Waiver

2021 TICKET TERMS OF USE

By purchasing, accepting, and/or using this ticket (“Ticket”) for entry into the facility and access to the 2021 Big Ten Conference Football Championship Game (“Event”), the person seeking entry to the Event (“Holder”) is deemed to have read the terms and conditions on this Ticket (“Terms”) and accepted and agreed to be bound by them. The Ticket is a revocable and personal license and may not be assigned or retransferred. The license granted by this Ticket may be revoked or terminated upon any unauthorized use of the Ticket or any other breach of the Terms. Breach of any Term of this ticket shall subject Holder to all legal remedies available.

While in the Facility, Holder must comply with any and all of the policies, protocols, guidelines, and requirements of The Big Ten Conference, the Event participants, and/or Lucas Oil Stadium (“Facility”), and any and all local, state, and federal laws, orders, guidelines, and requirements (which may be periodically revised in accordance with public health or other guidance), including, without limitation, any security policies, fan or attendee conduct policies, health and safety policies, and/or any applicable bag policy (collectively, “Policies”). Holder may be ejected or refused entry to the Facility for violation of any Policy or if Management, in its sole discretion, determines Holder poses a risk to the health and safety of other persons at the Facility. If Holder is ejected, a refund for the Ticket will not be provided. The Big Ten Conference reserves all rights to pursue all other available remedies for any and all violations of any Policies.

Tickets not obtained from authorized sources may be lost, stolen, or counterfeit, and may not be honored. Lost, stolen, or damaged tickets may neither be replaced nor refunded. A change in the date, location, and/or starting time of the Event shall not constitute a revocation or cancellation and shall not entitle Holder to a refund of the price of a Ticket. Every person, regardless of age, must have a Ticket to enter the Facility. Readmittance will not be allowed if Holder leaves the Facility.

Holder consents to any and all searches of his or her person and all items being carried onto the premises of the Event prior to or upon entry into the Facility and/or other security checkpoints in or at the Facility. Holder may place personal items in a clear bag not to exceed 12” by 6” and may also carry a small clutch bag no larger than 4.5” by 6.5”. Management reserves the right to prohibit backpacks, large bags, and similar items at the Event. Prohibited items may be confiscated.

Inquiries regarding parking and other services available for guests with disabilities may be obtained by telephoning Guest Services (317) 262-8600 Ticketing (317) 262-3389.

Holder may not bring alcoholic beverages, food, weapons (or any item Management may deem a weapon), bottles/tumblers, cans or containers, irritants (e.g., noisemakers), poles or sticks of any size, projectiles, fireworks, illegal substances, video cameras, strobe-lights, laser pointers, or other disruptive items onto the premises of the Event. Holder may not act in a disorderly manner. Signs, flags, and banners are not permitted within or affixed to the Facility without the approval of Management in its sole discretion. Promotional items (e.g., shakers, cups, flags, signs) with commercial slogans or identification are not allowed without the permission of The Big Ten Conference. Holder may not solicit contributions or distribute literature in or at the Facility or otherwise on the premises. Unless expressly authorized in writing in advance by The Big Ten Conference, this Ticket may not be offered as a prize in a sweepstakes, contest, or other promotion, or for any commercial purpose.

No video footage may be taken of the Event by the Holder without prior express permission of The Big Ten Conference. Holder may take photographs and distribute for personal use only, and not for commercial, promotional, or business purposes. Nothing in the Terms grants a right to use any trademarks, logos, or other intellectual property of The Big Ten Conference or its member institutions.

Even with the enhanced health and safety measures undertaken by the Facility, there is still an inherent risk of exposure to COVID-19 and other communicable and/or infectious diseases at the Facility and at the Event. COVID-19 in particular is an extremely contagious disease that can lead to severe illness and death. People who show no symptoms may spread COVID-19 if they are infected and, therefore, any event where people are present may pose a heightened risk of contracting COVID-19. By visiting the Facility and/or attending the Event, Holder knowingly and voluntarily assumes all risks related to exposure to COVID-19 or any other communicable and/or infectious disease.

Holder voluntarily assumes all risks incidental to attending and viewing the Event including, without limitation, risks related to personal injury (including, without limitation, injuries involving footballs, other equipment, players, performers, spectators, staff members, or thrown or otherwise-projected objects), property damage, and to exposure to COVID-19 or any other communicable and/or infectious disease. Holder agrees to release, hold harmless, waive, discharge, indemnify, and covenant not to sue The Big Ten Conference, its member institutions, Lucas Oil Stadium, the City of Indianapolis, the Marion County Convention and Recreational Facilities Authority, the Capital Improvement Board of Managers of Marion County, and the event participants; and each of their respective directors, officers, affiliates, heirs, beneficiaries, employees, volunteers, coaches, officials, independent contractors, equipment providers, agents, representatives, successors and assigns; and any other individuals and entities involved in and/or participating in the Event (collectively, “Event Organizers”) from all claims, liabilities, demands, causes of action, losses, fees, and expenses (collectively, “Claims”) directly or indirectly arising from or related to Holder’s attendance at the Facility and/or Event, including Claims attributable to the negligence of the Event Organizers. This acknowledgement, express assumption of risk, and release of liability is intended to be as broad and inclusive as is permitted by law. If any part of this provision is held to be invalid or legally unenforceable for any reason, the remainder of this provision shall not be affected thereby and shall remain valid and fully enforceable.

Holder shall indemnify and hold harmless the Event Organizers from any and all Claims arising out of or related to any act or omission by Holder, including any breach of any Term, or any allegation thereof.

In the event the name or likeness of the Holder appears or is otherwise included in any broadcast, telecast, photograph, video, film, digital transmission, audio recording, retransmission, and/or other media depiction of the Event, the Holder grants to The Big Ten Conference the nonexclusive, transferable, perpetual, irrevocable, royalty-free right and license to use, and to sublicense the use of, such name and/or likeness worldwide in any media now known or hereafter devised. Holder also grants permission to the Event Organizers, BTN, and FOX, and their affiliates and licensees, to utilize the Holder’s image, likeness, voice, actions, and statements in any medium (including, without limitation, audio, video, photograph, transmission, exhibition, or reproduction) or context for any purpose, including commercial or promotional purposes, without further authorization or compensation.

Holder also fully assumes, acknowledges, and agrees to the Terms—including the acknowledgement, express assumption of risk, and release of liability above—on behalf of any minor child(ren) at the Facility with Holder for whom Holder has the capacity to contract.
